GENERAL TERMS AND CONDITIONS OF SALE - and Special ConditionsZ Cool Store Services sales (online and on-site training)
Between the company Z COOL STORE, 15, Rue Paul Vaillant Couturier – 92300, Levallois-Perret represented by Mrs Solange Messina, in her capacity as manager, duly authorized for the purposes hereof.
The company can be contacted by email by clicking on the contact form accessible via the website's contact page. Hereinafter referred to as the "Seller" or the "Company" on the one hand, and the natural or legal person purchasing products or services from the company, hereinafter referred to as the "Buyer" or the "Customer" on the other hand, the following has been stated and agreed upon:
PREAMBLE
The Seller is a publisher of products intended for consumers, individuals and/or professionals, marketed through the website (https://www.zcoolstoreboutique.com). The list and description of the goods and services offered by the Company can be viewed on the aforementioned website.
ARTICLE 1: Purpose and General Provisions
These General Terms and Conditions of Sale define the rights and obligations of the parties within the framework of the online sale of Products and/or Services offered by the Seller. These General Terms and Conditions of Sale (GTC) apply to all sales of Products made through the Company's websites, which form an integral part of the Contract between the Buyer and the Seller. The Seller reserves the right to modify these terms at any time by publishing a new version on its website. The applicable GTC are those in effect on the date of payment (or the first payment in the case of multiple payments) of the order. The Company also ensures that their acceptance is clear and unreserved by setting up a checkbox and a validation click. The Customer declares to have read all of these General Terms and Conditions of Sale, and, where applicable, the Special Terms and Conditions of Sale related to a product or service, and to accept them without restriction or reservation.
The Client acknowledges having received the necessary advice and information to ensure the suitability of the offer to their needs. The Client declares that they are legally capable of entering into a contract under French law or are duly authorized to represent the natural or legal person on whose behalf they are acting. Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.
ARTICLE 2: Price
The prices of products sold through the website are indicated in Euros excluding VAT on the pages for products sold wholesale (B2B intended for professionals). They are indicated in Euros including all taxes (VAT + any other applicable taxes) on the pages for products sold retail. Prices are indicated excluding specific shipping costs. Our products and services are deliverable in Europe and the French Overseas Departments and Regions (DOM). Any other taxes (excluding VAT) are not collected by the Seller. They are the responsibility of the buyer (declarations, payment to the relevant authorities, etc.). The Seller therefore advises the buyer to inquire about these matters with the relevant local authorities if necessary. The Company reserves the right to modify product prices at any time. Telecommunication costs necessary to access the Company's websites are the responsibility of the Customer.
ARTICLE 3: Online Contract Conclusion
The Customer must follow a series of steps specific to each Product offered by the Seller in order to place an order. However, the steps described below are standard: ➢ Information on the essential characteristics of the Product; ➢ Selection of the Product, and where applicable, its options, and provision of the Customer's essential information (identification, address, etc.); ➢ Acceptance of these General Terms and Conditions of Sale; ➢ Verification of the order details and, where applicable, correction of any errors; ➢ Following the instructions for payment and delivery. The Customer will then receive email confirmation of payment for the order, as well as an order acknowledgment confirming the order. For products to be delivered, delivery will be made to the address provided by the Customer. For the proper execution of the order, and in accordance with Article 1316-1 of the French Civil Code, the Customer agrees to provide valid identification information. The Seller reserves the right to refuse the order, for example, for any request deemed fraudulent or for any other legitimate reason.
ARTICLE 4: Products and services
The essential characteristics of the products and services, as well as their respective prices, are available to the buyer on the company's website. The customer acknowledges having received information regarding delivery charges and payment terms. The Seller undertakes to fulfill the Customer's order within the limits of available stock or within 5 to 10 business days. If this is not possible, the Seller will inform the Customer. This contractual information is presented in detail and in French. In accordance with French law, it is summarized and confirmed when the order is validated.
The parties agree that illustrations or photos of products offered for sale are not contractually binding. The validity period of product offers and their prices are specified on the Company's websites. Unless otherwise specified, the rights granted hereunder are granted solely to the individual or legal entity that placed the order (or the individual or legal entity whose email address was provided). In accordance with legal provisions regarding conformity and latent defects, the Seller will refund or exchange defective products or products that do not correspond to the order. ARTICLE 5: Retention of Title Clause
The products remain the property of Z COOL STORE until full payment of the price.
ARTICLE 6: Delivery Terms
The products are delivered to the delivery address indicated when the order was placed, within the following maximum timeframes:
5 to 10 business days for retail items, depending on order volume; 5 to 6 weeks for wholesale and made-to-order items. Deliveries may be made in multiple shipments.
These maximum timeframes may be impacted by the health crisis and its consequences on logistics operators.
When the Customer orders several products at the same time, these may have different delivery times depending on whether the items are available in stock or need to be manufactured. Carrier delivery times may also vary. In the event of a delivery delay, the Customer has the option to cancel the sales contract under the terms and conditions defined in Article [Article number missing in original text]. L Article 138-2 of the Consumer Code. The Seller then proceeds with the refund of the product and shipping costs under the conditions of Article 138-2. L Article 138-3 of the Consumer Code. The Seller provides a point of contact via the order confirmation email to ensure order tracking. The Seller reminds the Customer that upon physical receipt of the products or services, the risk of loss or damage to the products is transferred to them. It is the Customer's responsibility to notify the carrier of any reservations regarding the delivered product.
ARTICLE 7: Availability and presentation
Orders will be processed subject to product availability at the Seller's warehouse or subject to raw material availability at the Seller's supplier(s). If an item is unavailable and cannot be manufactured within 15 business days, the Customer will be notified of the expected delivery time and the order for that item may be canceled upon request. The Customer may then request a credit note for the amount of the item or a refund via the original payment method.
ARTICLE 8: Payment
Payment is due upon ordering, including for products that will be manufactured. The Customer may pay by credit card (from the list of cards accepted by the website) or via their financial partner by bank transfer. The Z COOL STORE website is secured by MyShopify and PayPal. Payments are processed by the PayPal platform, which handles the encryption and collection of sensitive information necessary for payment. Once the payment is validated by the Customer, the transaction is immediately debited after verification of the information. In accordance with Article LPursuant to Article 132-2 of the French Monetary and Financial Code, the commitment to pay by card is irrevocable. By providing their bank details during the sale, the Customer authorizes the Seller to debit their card for the amount corresponding to the stated price. By doing so, the Customer confirms that they are the legal cardholder and are legally entitled to use it. In case of error or if the card cannot be debited, the Buyer may choose to pay by bank transfer or via Paypal.me/ZCS-FR
ARTICLE 9: Right of withdrawal
The consumer has 14 working days to exercise their right of withdrawal without having to give reasons or pay penalties, except, where applicable, for return shipping costs, in accordance with Article LArticle 121-20 of the Consumer Code. The period mentioned in the preceding paragraph runs from the validation of the order on the website or from the acceptance of any off-website offer for B2B services relating to bulk orders. The right of withdrawal can be exercised by contacting the Company via the "Contact Us" form on the website. The Seller informs the Customer that, in accordance with Article L. 121-20-2 of the Consumer Code, this right of withdrawal cannot be exercised in the event of non-payment.
If the right of withdrawal is exercised within the aforementioned period, only the price of the product(s) or service(s) purchased and the initial shipping costs will be refunded; return shipping costs remain the responsibility of the customer. Returned products must be in their original condition and complete (packaging, accessories, instructions, etc.) so that they can be resold as new; they should, if possible, be accompanied by a copy of the proof of purchase. Refund procedure: In accordance with legal provisions, the customer will receive a standard withdrawal form upon request via the "Contact Us" form on the website. ARTICLE 10: Guarantees
In accordance with the law, the Seller provides two guarantees: conformity and against hidden defects in the products. The Seller will refund the buyer or exchange products that are apparently defective or do not correspond to the order placed. Refunds or exchanges will be processed upon receipt of the returned goods.
ARTICLE 11: Complaints

ARTICLE 12: Intellectual Property Rights
Trademarks, domain names, products, software, images, videos, texts, or more generally, any information subject to intellectual property rights are and remain the exclusive property of the Seller. No transfer of intellectual property rights is made through these Terms and Conditions. Any reproduction, in whole or in part, modification, or use of these assets for any reason whatsoever is strictly prohibited.
ARTICLE 13: Force majeure
The Seller's obligations under this agreement shall be suspended in the event of a fortuitous event or force majeure that prevents their performance. The Seller shall notify the Customer of such an event as soon as possible.
ARTICLE 14: Nullity and modification of the contract
If any provision of this contract is held to be invalid, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect between the parties. Any contractual modification shall be valid only after a written agreement signed by both parties.
ARTICLE 15: Protection of personal data
In accordance with the French Data Protection Act of 6 January 1978 and the European General Data Protection Regulation (GDPR) which came into effect on 25 May 2018, you have the right to access, modify, object to, and rectify your personal data. By agreeing to these terms and conditions of sale, you consent to our collection and use of this data for the performance of this contract. By entering your email address on one of the websites in our network, you will receive emails containing information and promotional offers concerning products published by the Company and its partners. You can unsubscribe at any time. Simply click on the link at the bottom of our emails or contact the data controller (the Company) by registered letter with acknowledgment of receipt. We track website traffic using tools such as Google Analytics.
ARTICLE 16 Limitation of Liability Clause
A limitation of liability clause is stipulated for the Seller for products sold by the Seller and manufactured by our production partners. ARTICLE 17: Applicable Law All clauses contained in these general terms and conditions of sale shall be governed by French law.

ARTICLE 17 Special case of Z Cool Store Services (Online course)
All our courses are personalized to best suit each student or group.
How does it work?
1 - You order your package

- your ZOOM appointment notification that you can insert into your Google calendar or other calendar,
- as well as the link to the course.
Generally, the teacher will be online 9 to 5 minutes before the start of the class.
The class lasts 50 minutes, please be on time!
Z Cool Store Services makes every effort to guarantee the best possible customer experience for all its students. However, events may occasionally disrupt the smooth running of our business.
That is why we wanted to define the few basic rules below.Mthank you forbecome awareof these general terms and conditions of sale because any purchase of courses on our platform constitutes acceptance of these general terms and conditions of sale.
In case of a technical problem due to the student's equipment
It must be reported at least 20 minutes before the start of the course to the following address:support@zcoolstore.com-otherwise the course will be considered completed
If a technical problem occurs during the course, a technical analysis will be conducted to determine whether the course credit will be refunded or considered used. The decision will rest with the sales department of Z Cool Store Services.
In case of a technical problem due to the teacher's equipment
The student will be credited again and their course rescheduled taking into account the teacher's schedule and, as much as possible, the student's availability.
In case of various unavailability issues (forgotten appointments, lateness, etc.) on the part of the student
The course cannot be refunded. Except in special circumstances, which must be justified to the sales department of Z Cool Store Services, the only authority empowered to decide whether or not to refund the course.
In case of various unavailability issues (forgotten appointments, delays, etc.) on the part of the teacher
The course will always be credited.
ARTICLE 18 Special case of Z Cool Store Services (Scribe and office automation training)
We strive to adapt as much as possible to the technical configuration of each client's equipment.
The customer's equipment
The computers and software - must be suitable for the service.
Case of cancellation of service by Z Cool Store
We reserve the right to refuse service in the following cases:
- if the equipment announced by the client when purchasing the service turns out to be non-compliant and does not allow the service to be performed.
- if the customer's address does not match the one provided by the customer when purchasing the service
- if the service requested does not conform to the content of this service "Scribe and office automation trainer".
Cancellation of services will result in the refund of sums paid less a flat travel cost of €150 if the trainer had to travel to the client's site at least once.
In case of a technical problem due to the customer's equipment
It must be reported at least 3 hours before the start of the service to the following address:support@zcoolstore.com-Otherwise, the service will be considered completed.
If the technical problem occurs during the service, a technical analysis will be made to consider whether to credit the service or consider it consumed.
The decision will be made by the sales department of Z Cool Store Services and supporting documentation can be provided upon request.
In case of various unavailability issues (forgotten appointments, lateness, etc.) on the part of the client
A portion of the service corresponding to 2 hours will be deducted from the package. Exceptions must be justified to the Z Cool Store Services sales department, which is solely authorized to decide whether or not to credit the relevant portion of the package.
In case of various unavailability issues (forgotten appointments, delays, etc.) on the part of the teacher
The customer's package will not be reduced.
